Thanks Jay ... the claim was against him personally and not against U8 performance as a company. he owns a new civic type r, has an fn2 civic for track use, a fiat uno turbo restoration and various Japanese cars rotting in his yard - approximately 20 of them. He’s a home owner as well so when the sheriff turns up knocking on his door (Scottish version of a bailiff, they can force entry too) I will get some money back , I hope 🤞
  2. Yeah this is clearly the hard part. even though I’ve gone through 8 months of dealing with this I’m still lumbered with some scrap metal and some solicitor fees to come. he owns several cars so he has assets and he will be receiving a letter v soon to start proceedings

  5. Hello all here’s an update. I think it is worth writing down for people to read, just in case they come across something similar. So Andy Napier of u8 performance didn’t turn up to court for our hearing. Funny, as he appealed and paid for the hearing. In hindsight this was another delaying tactic and Andy never had the intention of dealing with this problem. He sold me a dangerous and badly built car that didn’t last 500 miles and shirked his responsibilities as a car dealer by pretending to be a private seller. My evidence must have been too conclusive for him to even turn up to court and he was probably advised not to show up. He would have had to explain too many things. The court has awarded me judgement and I’ve instructed solicitors now to chase him for the money. He also has a CCJ or Scottish equivalent on his name. Andy ran RA Motorsport which went into liquidation then opened U8 performance in Perth, Scotland. He also organises and event called SLS super lap Scotland’s which he competes in. I’m sure I helped fund his Honda Civic build for this years competition. Or maybe his Fiat Uno turbo resto. Or perhaps one of his Evos ?? anyway ... Thanks for all the support and responses on here it really helped. L
  6. Ok so now he’s appealed and we go to court in January. its been quite a tiresome and stressful process and I’m quite happy there’s a hearing now so I’ll get some closure either way.
  7. Just to update this thread, I have won the case by default as Andy didn’t respond to the evidence provided. im now actively chasing him legally for the money as I doubt he’s going to Pay up as requested by the courts.
  8. Yes it’s very important. But he’s acting like a private seller but has sold multiple vehicles so he’s trying to avoid the responsibility of the consumer rights act 2015 by doing so
  9. Thanks ... we will see ... he wants to go to court now and hasn’t sent me any correspondence at all. I only know this as I’ve text him and he text me back. Thing is he’s been selling a lot of cars . It would be good to know if anyone on here has bought from him recently ?
  10. I think more people should speak out about these types of incidents. there’s a hint of What’s potentially wrong but not enough. He’s coming across as a crook which is not a good look in anyone’s eyes. The car I got is not as described and is almost unroadworthy. Worst of the worst in terms of used car sales and used his “reputation” to get me to pay a deposit and gain trust needs to be exposed and I’ll fight this until I have a result and I’ll let you know. Quite a few more details have popped up in my favour ... I’ll keep you all posted
  11. Actually after doing some research we have the same laws in England as we do in Scotland. In fact it is UK LAW that is in operation . I too have had a message back talking of “Scottish law” and having to come to Scottish courts with a Scottish solicitor but this is untrue in a small claims court. i imagine your friend was intimidated and warned off further action as I was. Including “don’t take the car to another garage “ was directed at me .. Such bad and unprofessional practice from someone known within a car community. im not letting this go ..... I worked hard for my money and I’m not going to have it stolen off me .
  12. Yes it is !! My guess is he’s so desperate for the money. He could be refunding a load of SLS tickets or heavily investing in one of his many personal builds

  17. Thanks for this information The car is bodged together and I’m going to go to the small claims court. I have more than enough evidence I think.
  18. Also comments were that the engine is extremely tired and on its last legs. Not in keeping with a fresh engine rebuild, one that has done 1000 miles. sensor replaced with a piece of metal, wheel bolts too short ..... could go on

Ok so I got the report back from perfect touch and it’s not looking good. engine check light is for the VVT SYSTEM this time oil leak from the sump and the rocker cover Compression and leak down test. 1 95 psi =6% 2 60 psi =50% 3 80 psi = 24% 4 80 psi = 38% When doing compression test the pressures come up slowly, looked inside barrels with camera and can see damage to barrels and lots of oil is present. there are more issues concerning rust etc i have sent a letter to the seller with the report and he wants court action apparently ....
  20. I think the point of the camera is to inspect the pistons to Check if they’re forged. I’ll get a compression test and a leak down test done too before stripping the engine. But yes likely it will need taking apart
  21. @savage bulldogs thanks for the info.Really appreciated I’ve now re booked The car into another garage not Jem They’ve got endoscopes Etc and they are going to do a thorough investigation. also looking at mot history now how has he done the running in miles when the car was SORN? It’s going to be interesting... after filling up witH oil, I started the car and it’s definitely burning it. Smoke puffs and black oil from the exhaust ..😬

Not stupid to ask but I was a little as I always check the oil but for some reason I didn’t as I was getting the whole explanation of the rebuild and stupidly trusted him although I’m my head I was thinking I should have checked it all the way home . he Also said he should have checked it too but what type of mechanic wouldn’t check this before selling. He said he was preparing it for pick up ..
  25. So as this is a private sale I can only try and recoup repair work as damages. ..... I don’t think Jem Subaru have an endoscope and cameras so would need to strip the engine to see What’s in there also head gaskets weren’t uprated he states genuine Subaru gaskets but I’ll still have a look. Also the first code that came up was wastegate solenoid high input. I don’t know what that would mean mechanically
